Terms of Service

You must be at least 18 years old. By creating an account you confirm that you are. If we learn that an account belongs to someone under 18, we will close it.

You may use Kosmo for yourself or on behalf of your employer or another organisation. If you do, you confirm you are allowed to accept these terms for them.

Give accurate details when you sign up and keep your sign-in secure. You are responsible for what happens under your account. One person per account; do not share it. Tell us at legal@askkosmo.com if you think someone else has used it.

Kosmo is an AI system. It asks you about what you want to achieve and writes prompts and instructions for you to use in other AI tools. Its replies and the prompts it writes are generated by AI models.

AI output can be wrong, incomplete or unsuitable for your purpose, even when it sounds confident. Kosmo does not give professional advice, including legal, medical, financial, tax or safety advice, and nothing it writes is a substitute for that advice. Check anything important before you rely on it or act on it.

Kosmo writes for third-party tools such as ChatGPT, Claude, Gemini and Cursor. We are not affiliated with or endorsed by those companies. Your use of their tools is governed by their terms, and we are not responsible for what they do with a prompt or what they produce.

• Each completed compile uses one credit. Chatting with Kosmo does not use credits, but chat has daily limits that depend on your plan and are shown on our Pricing page. We may slow or pause use that is unusually heavy or automated, to keep Kosmo fair for everyone.
• If a compile fails because of a problem on our side, it is not charged, or the credit is returned.
• New accounts receive a small number of free credits. We may also give free credits from time to time, for example to returning users, while such offers last. Free credits have no cash value and cannot be transferred or exchanged.
• Plans give you a set number of credits for each billing period. Unused plan credits do not carry over; your allowance resets when the plan renews.
• Credit packs and top-ups give you the number of credits shown when you buy them, with the expiry (if any) shown at that time.
• Prices, credit amounts and taxes are shown before you pay. We may change prices or credit amounts for future purchases; if you have a plan, we will tell you before a change applies to your next renewal, and you can cancel before it does.
• Payments are processed by Razorpay (for purchases in Indian rupees) or by Lemon Squeezy (for purchases in other currencies). For purchases through Lemon Squeezy, Lemon Squeezy is the seller of record and its buyer terms also apply. We never see or store your full card number.
• Plans renew automatically at the end of each billing period until you cancel.

You can cancel a plan at any time; it stays active until the end of the period you have paid for. Our Refund and Cancellation Policy explains how to cancel, when you can get a refund, and your rights if you live in the EU or the UK. It forms part of these terms.

Do not use Kosmo to:

• break any law or help anyone else break one;
• create content that harms, harasses, defrauds or deceives people, or that infringes someone else's rights;
• try to produce material that is illegal where you or the recipient are, including material that sexualises children;
• get around the safety rules of Kosmo or of the AI tools you use its prompts with;
• copy, scrape, resell or rebrand the Service, or access it by automated means we have not approved;
• probe, overload or interfere with the Service, or bypass credit or usage limits;
• reverse engineer the Service, except where the law allows it.

We may limit, suspend or close accounts that break these rules (section 10).

Yours. You keep ownership of what you give Kosmo (your messages, answers and ideas) and of the prompts Kosmo produces for you, to the extent the law allows anyone to own AI output. You give us permission to store and process that content only as needed to run, secure and support the Service for you, as our Privacy Policy describes. We do not use your content to train AI models.

Because AI output is generated, a prompt Kosmo writes for you may be similar to one written for someone else, and we cannot guarantee that output is unique or free of other people's rights.

Ours. Kosmo's software, design, brand, prompts library and documentation belong to us. These terms do not give you any right to them beyond using the Service.

Feedback. If you send us suggestions, we may use them without owing you anything.

Our Privacy Policy explains what personal data we collect, why, who we share it with and your rights. It includes how account deletion works: when you delete your account, it can be restored for 30 days, and after that your content is permanently deleted.

We are improving Kosmo continually and may add, change or remove features. If we make a material change to these terms, we will tell you by email or in the app before it takes effect, and ask you to accept the new version before you continue to use Kosmo. If you do not accept it, you can stop using Kosmo and cancel your plan.

You can stop using Kosmo at any time, and delete your account from Account settings (cancel any active plan first) or by emailing legal@askkosmo.com.

We may suspend or close your account if you break these terms, if we must do so by law, or if your use creates a risk to Kosmo, other users or third parties. Where reasonable we will tell you why first and give you a chance to fix the problem. If we close your account without a good reason under these terms, we will refund any unused, prepaid part of your plan.

We work to keep Kosmo available and accurate, but we provide it "as is" and "as available". To the extent the law allows, we do not promise that the Service will be uninterrupted or error-free, or that its output will be accurate, complete or fit for a particular purpose.

Nothing in these terms limits or excludes liability that cannot be limited or excluded by law, including liability for death or personal injury caused by negligence, or for fraud.

Subject to that, and to the extent the law allows:

• we are not liable for indirect or consequential loss, or for loss of profits, revenue, data or business opportunity;
• our total liability to you for all claims relating to the Service is limited to the amount you paid Kosmo in the 12 months before the event giving rise to the claim, or INR 5,000 (or its equivalent) if that is higher.

If you are a consumer in the EU or the UK, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill; we are not responsible for loss or damage that is not foreseeable.

If you use Kosmo for business purposes and your use of it in breach of these terms or the law causes a claim against us, you agree to cover our reasonable losses and costs from that claim. This section does not apply to consumers where local law does not allow it.

These terms are governed by the laws of India.

If you have a problem, please contact us first at legal@askkosmo.com; most issues are resolved that way. If a dispute is not resolved within 30 days, it will be settled by arbitration under the Arbitration and Conciliation Act, 1996, by a sole arbitrator, with the seat and venue in Nagpur, Maharashtra, in English. Subject to that, the courts at Nagpur have exclusive jurisdiction.

This section does not take away your rights as a consumer:

• if you are a consumer in India, you may bring a complaint before a consumer commission under the Consumer Protection Act, 2019, instead of arbitration;
• if you are a consumer in the EU, the UK or another country whose law gives you the right, you may bring proceedings in the courts where you live, and the mandatory consumer protections of that country's law apply.

• These terms, the Privacy Policy and the Refund and Cancellation Policy are the whole agreement between you and us about the Service.
• If any part of these terms is found unenforceable, the rest still applies.
• If we do not enforce a term straight away, we can still enforce it later.
• You may not transfer your rights under these terms without our written consent. We may transfer ours to a business that takes over Kosmo (for example, a company we set up to run it), and we will tell you if we do; your rights under these terms will not be reduced.
