1. Agreement to Terms

These Terms of Service ("Terms") are a binding agreement between you and Kosmo ("we," "us," "our"), governing your access to and use of askkosmo.com and the Kosmo application (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be able to form a binding contract to use the Service, and you must provide accurate information when creating an account. You are responsible for your account credentials and for all activity that occurs under your account. Notify us promptly at hello@askkosmo.com if you suspect unauthorized use.

3. Early Access / Beta Disclaimer

The Service is currently in early access (beta). We make no warranties regarding uptime, availability, or feature completeness. Features, pricing, and free-credit allowances may change as we move toward a stable release, and we will make a reasonable effort to communicate material changes.

4. Acceptable Use

You agree not to use the Service to:

Violate any law, or the terms of service of any third-party AI tool the Service's output is intended for;
Generate malicious code, or content intended to harm, deceive, or defraud;
Scrape, reverse-engineer, or attempt to extract the Service's internal prompts, models, or architecture;
Interfere with or overload the Service's infrastructure, or attempt to bypass usage limits;
Resell or offer the Service's output as a substitute, white-labeled service.

5. Compile Credits & Billing

The Service is billed on a credit basis: each completed request ("compile") consumes one credit. New accounts receive a starting allotment of free credits with no cash value and no guaranteed refill. Where paid credit packs or subscription plans are offered, their price, quantity, and any expiration window are disclosed at the time of purchase and are subject to change for future purchases.

If a compile fails because of an error on our side, the credit for that request is not charged (or is automatically restored). We do not guarantee that a specific compile will meet your expectations, and purchasing credits does not guarantee any particular output quality.

6. Refunds & Cancellation

Purchases of credit packs and subscriptions are generally final. If you believe you were charged in error, or a paid compile failed to deliver due to a system error, contact hello@askkosmo.com and we will review it individually. Because self-serve billing management is not yet available during early access, contact us directly to change or cancel a subscription.

7. Intellectual Property

Unless otherwise indicated, the Service is our proprietary property, and all source code, databases, functionality, software, designs, and content on the Service are owned or controlled by us. You retain ownership of the prompts, intents, and other content you input into the Service, and of the compiled output the Service produces for you.

8. Third-Party AI Tools

Kosmo generates prompts and specifications intended for use with third-party AI tools (for example, Claude, ChatGPT, Cursor, or Gemini). We are not affiliated with, and are not endorsed by, those providers. Your use of any third-party tool is governed by that provider's own terms, and we are not responsible for their availability, output, or policies.

9. Disclaimer of Warranties & Limitation of Liability

10. Termination

We may suspend or terminate your access to the Service if you violate these Terms, including the Acceptable Use section above. You may stop using the Service at any time. Sections that by their nature should survive termination — including Intellectual Property, the disclaimer and liability section, and Governing Law — will survive.

11. Changes to These Terms

We may update these Terms from time to time. We will update the "Last updated" date above when we do. Continuing to use the Service after a change takes effect constitutes acceptance of the revised Terms.

12. Governing Law
